Sprouts Farmers Market, Inc. (together with its affiliates, “Sprouts,” “we,” “us,” or “our”) developed this Privacy Policy as an extension of our commitment to combine the highest-quality products and services with the highest level of integrity in dealing with our valued customers, and the companies, businesses, and organizations they represent. This Privacy Policy applies to information collected within our stores, through our websites and mobile applications (collectively the “Site”), and anywhere else we interact with you.

1. Collection of Information.

Our collection of information depends on how you interact with us and our products and services. Some of the information we collect includes personal information that can be used to identify you (“Personal Information”). The Personal Information we collect may include, without limitation, your name, mailing address, telephone number, email address, dietary information, and financial information (e.g., your credit card number). We retain your Personal Information only for as long as is necessary for the business purpose for which we collect it, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we obtained the information and whether we can achieve those purposes through other means, as well as applicable legal requirements.

Information You Provide to Us. All credit or debit card information you provide is processed directly by our third-party payment processor. Sprouts does not directly access, handle, or store your credit or debit card information. To perform a transaction, you may need to provide your card type, card number, expiration date, security code, and billing address. All credit or debit card transactions are subject to the approval of the card issuer. We will maintain a record of your transactions with us and your purchase information may be matched with other information you provide in other contexts, such as via your Sprouts account.

  • Payment Information You Provide. All credit or debit card information you provide is processed directly by our third-party payment processor. Sprouts does not directly access, handle, or store your credit or debit card information. To perform a transaction, you may need to provide your card type, card number, expiration date, security code, and billing address. All credit or debit card transactions are subject to the approval of the card issuer. We will maintain a record of your transactions with us and your purchase information may be matched with other information you provide in other contexts, such as via your Sprouts account.

Account Activity. If you use our Site while signed into your Sprouts account, or if you make purchases at a Sprouts store or through the Site using a payment card that you have used in connection with your Sprouts account, we will collect information on how you use your Sprouts account and the services we offer, as well as information about your purchases. For example, we will collect coupons clipped, catering order history, recipes saved, and transaction data (i.e., purchase history).

IP Addresses and Related Data. We use technology that automatically may collect data from your devices (computer, mobile phone, tablets, etc.) when you visit our Site. This information could include your IP address assigned, your mobile device ID numbers and identifiers, your browsing and click history, your geolocation, as well as information about how you navigate and use our Site.

Location Information. When permissible, you may provide your approximate geographic location information such as your zip code or address when locating stores or requesting other location-related services we may provide. You may provide a more precise location when prompted for elevated location-related functionality. This includes both geographical location information that you provide (e.g., when you enter your zip code or physical address) and geographical location information collected by device-based location services (including GPS data).

Cookies. We use cookies to track Site use, to facilitate and enhance the user experience, and for advertising. Cookies are small pieces of data that are stored by a user’s web browser on the hard drive of a user’s computer. Cookies can “remember” what information a user accesses on a digital platform to simplify subsequent interactions with that website by the same user, or can use that information to streamline the user’s transactions. The cookies that Sprouts uses may be “session” Cookies that are erased when you leave or may be “persistent” Cookies that remain on your computer’s hard drive and may track you over time and across third-party websites. Our Site may use both cookies that we implement and cookies implemented by our suppliers and other third parties. We use cookies to improve our Site, customize your user experience, speed up searches, recognize when you, conduct analytics, and for advertising purposes. See the “Advertising and Tracking Technologies” section below for more information. Most browsers automatically accept cookies, though you may refuse to accept cookies by activating appropriate settings on your browser. If you select this setting, you may be unable to access certain features of our Site.

A. Social Media. You may connect and share information with various social media platforms. We may share information that you provide us or that we may collect with those platforms and that information will be subject to their privacy policies. We may also use the advertising services and networks offered by those social media platforms to deliver advertising content. Use of these services requires social media platforms to implement cookies or pixel tags to deliver ads to you while you are logged into the platform. Besides the other mentions discussed in this privacy policy, If you do not wish for a social media platform to collect information relating to you via our Site, we suggest that you: (a) hide social media platform plug-ins using an ad blocker; (b) always log off completely from the social media platform before visiting other websites and delete all related cookies; and, (c) where the option made available by the social media platform, disable the advertising services and networks operated by that platform.

B. Embedded Content. We may incorporate content, including feeds scripts embedded in our code as well as visible content (for example, videos), provided by third parties. In some cases, those third parties collect data about how you interact with their content. For example, YouTube may collect or otherwise have access to usage data on videos embedded on our website as described in YouTube’s Privacy Policy.

C. Advertising and Tracking Technologies. From time to time, we may utilize advertising networks, personalized advertising, remarketing, retargeting and related advertising services that are managed and provided by third-party advertising servers, advertising agencies, technology vendors, and research firms, including advertising retargeting services provided by Meta (sometimes referred to the Facebook “tracking pixel”) and Google (e.g., Google Analytics, Google Ads). These services collect information about your visits to and interactions with the services and other websites and will use that information to target advertisements for goods and services. These targeted advertisements may appear on our Site or other websites. Advertising networks often gather data about consumers who view advertisements to make inferences about a consumer’s interests and preferences, which enables their computers to deliver advertisements directly targeted to the consumer’s specific interests. In addition to the other methods discussed in this Privacy Policy, to opt out of remarketing advertising provided through Google, to customize your ad preferences, or to limit Google’s collection or use this information, visit Google’s Safety Center and Google’s Ad Settings and follow Google’s personalized ad opt-out instructions. Opting out will not affect your use of the Site. To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, please visit the National Advertising Initiative Consumer opt-out page at http://www.networkadvertising.org/choices or the Digital Advertising Alliance Self-Regulatory Program at http://www.aboutads.info. Please remember that changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads from time to time. See the “Your Privacy Choices” section of this notice for other means some consumers have to opt out.

Other Sources. We may also collect information about you from other sources, including, for example, third parties, business partners, our affiliates, or publicly available sources.

State-specific Collection Information. Some states require that organizations disclose whether the following categories of Personal Information are collected, disclosed to third parties for a “business purpose,” or “sold” or transferred for “valuable consideration.” The table below indicates the categories of Personal Information we collect and transfer in a variety of contexts. Sprouts does not sell your Personal Information for money. As discussed elsewhere in this Privacy Policy, we use cookies and similar tracking technologies for purposes of online-behavioral advertising. For more information, see the “Cookies” and “Advertising and Tracking Technologies” sections. The table below indicates the categories of Personal Information we collect and transfer in a variety of contexts. Please note that because this list is comprehensive, it may refer to types of information that we collect and share about people other than yourself. For example, while we transfer credit card or debit card numbers for our business purpose in order to process payments for orders placed with us, we do not collect or transfer credit card or debit card numbers of individuals that submit questions through the “how to contact us” section of our Privacy Policy.

  • Inferred Data, data drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

We may also disclose your Personal Information, with your consent, in other situations not disclosed above. To the extent that we use deidentified data, we will maintain and use the information in deidentified form and not to attempt to reidentify the information, except for the sole purpose of determining if its deidentification process is satisfactory.

2. Using Your Information.

Examples of how we may use your information that we collect include the following:

Improvement of Services. We may use information we collect to analyze, develop, and improve the content, functionality, materials, products, and services that we make available through our Site or Sprouts stores.

Transactional Purposes. We may use your information to process your orders, purchases, and registrations, and to communicate information related to your Sprouts account or purchases and to provide customer service in general. We also may use your information to administer our rewards program if you are enrolled.

Marketing Purposes. We may use your information to communicate promotional offers, discounts, coupons, sweepstakes, rewards, new products and services, and other special offers we determine may be relevant to you based on browsing or purchasing history.

Analytical Purposes. Sprouts may use this information to generate statistical information, to monitor and analyze website, mobile app, and in store traffic and usage patterns.

3. Sharing of Information.

In addition to the specific situations discussed elsewhere in this Privacy Policy, we may disclose Personal Information in the following situations:

Affiliates and Acquisitions. We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). This includes circumstances in connection with the sale, purchase, merger or reorganization of Sprouts, including at the negotiation stage.

Other Disclosures without Your Consent. We may disclose information (a) to protect the rights, property or safety of Sprouts or other persons, or to comply with a judicial proceeding, court order, or legal process served on Sprouts (including by disclosing information we collect to law enforcement), in each case to the extent permitted by law; (b) to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies; or (c) to comply with your request for the shipment of products to or the provision of services by a third-party intermediary.

Public. Some of our websites may provide the opportunity to post comments, or reviews, in a public forum. If you decide to submit information on these pages, that information may be publicly available.

Partner Promotion. We may offer contests, sweepstakes, or other promotions with third party partners. If you decide to enter a contest, sweepstakes, or promotion that is sponsored by a third-party partner, the information that you provide will be shared with us and with them. Their use of your information is not governed by this Privacy Policy.

Service Providers. We share your information with service providers. Among other things, service providers help us to administer our Site, conduct surveys, provide technical support, process payments, and assist in the fulfillment of orders.

Other Disclosures with Your Consent. We may disclose your information to other third parties when we have your consent or direction to do so.

4. Protecting Collected Information.

Sprouts does not guarantee that loss, misuse, or alteration of information it collects will not occur, but we have reasonable security measures in place designed to help protect against the loss, misuse, and alteration of information under our control. If you have any questions about the security of your Personal Information, you can send Sprouts an email at [email protected]. No method of transmission over the Internet, or method of electronic storage and communication of information is completely secure. Sprouts expressly disclaims any promise or representation, express or implied, as to the security of information it collects. If you become aware of any breach of security with respect to Sprouts or this Privacy Policy, please notify us immediately at [email protected] or using our Contact Us form. If our security system is breached, we will notify you of the breach only if and to the extent required under applicable law. Such notification may be in the form of an email, letter, or telephone call or text.

5. Children’s Privacy.

Sprouts does not knowingly collect or use information from children under the age of thirteen (13). Please contact us if you believe we have collected Personal Information about a child without consent from their parent or guardian and we will take necessary steps to remove that information from our system.

6. Access from Outside of the United States.

If you are accessing our Site from outside the United States, please be aware that information may be collected and may be transferred to, stored in, and processed in the United States (where our and our suppliers’ servers and databases are located and operated). The data protection and related laws and regulations of the United States might not be as comprehensive as those in the country from which you are accessing our Site. By submitting your Personal Information to us, you are transferring, storing and processing your information in a country other than your country of residence including, but not necessarily limited to, the United States.

7. Your Choices.

Some jurisdictions, including California, Colorado, Delaware, Maryland, New Jersey, Tennessee, Texas, Utah, and Virginia give their residents a right to make the following choices regarding your Personal Information:

  • Access To Your Personal Information and Confirmation of Processing. You may request access to your Personal Information (or confirmation that we have information about you) by contacting us at the address described below. If required by law, upon request, we will grant you access to the Personal Information that we have about you. Note that residents in certain jurisdictions may be entitled to information describing what categories of Personal Information (if any) we share with third parties or affiliates.
  • Right of Portability.You may have the right in certain circumstances to receive the Personal Information we hold about you in a readily useable format to allow you to transfer it to another entity, to the extent this is technically feasible.
  • Changes To Your Personal Information. We rely on you to update and correct your Personal Information. Our Site typically allows you to modify or delete your account profile. You can also contact us at the address described below in order to request that your Personal Information by modified. Note that we may keep historical information in our backup files as permitted by law.
  • Deletion Of Your Personal Information. Typically we retain your Personal Information for the period necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law, including to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purposes. You may, however, request that we delete your Personal Information by contacting us at the address described below.
  • Obtain a List of Third Parties. In addition to the third parties we describe in the “Sharing Your Information” section above, we may share the names of third-parties to which Sprouts generally discloses Personal Information. To do so, please select “Access personal information” as your request type in the Data Subject Request Form (described below) and state that you would like to obtain a list of third parties with whom Personal Information is disclosed in the request description box.
  • Online Tracking. We do not currently recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.
  • Opt Out of Targeted Advertising.You may opt out of targeted advertising by visiting the Cookie Preferences located at the footer of our website. For more information on how to opt-out see the “Advertising and Tracking Technology” section. In some jurisdictions, you may also be able to opt out of targeted advertising by enabling the Global Privacy Control (“GPC”). Where required by law, we recognize GPC as a valid opt out request.
  • Promotional Text Messages. If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP.”

Exercising your Privacy Rights. You may exercise the rights described above by using our Data Subject Request Form, or by calling us toll-free at 888-577-7688 ext. 2. When a request is made, we may verify your identity to protect your privacy and security. Upon receiving your request, we will take measures to verify that the request is legitimate. These verification efforts may require additional information from you which may include information you have provided us in the past. For instance, if you have previously provided your name to us, we may ask you for other information (e.g., last four digits of your credit card, email address, phone number, rewards information) so that we can match the new information you provide with the information we have. We may also use other verification methods as the circumstances dictate. If through reasonable efforts we are unable to verify your request to a reasonable degree of certainty, we will notify you, and may be unable to effectuate your request. Please note that these rights are not absolute, and you may be limited to exercising certain of your rights in certain instances, such as exercising some rights no more than twice per calendar year. We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy.

Using an Authorized Agent. If the jurisdiction you are in grants you the ability to assert your rights via an Authorized Agent (the “Agent”), we require that your Agent provide a valid power of attorney asserting their right to act on your behalf, which satisfies the requirements of California Probate Code Sections 4121 to 4130. Please note that if a power of attorney cannot be provided, we reserve our rights under relevant law to request additional information such as: (i) confirmation you have provided the Authorized Agent to act on your behalf; (ii) verification of your identity with us; and (iii) direct confirmation from you that the entity seeking to assert your rights is an Authorized Agent acting with your permission. Once verified, and Agent may make a request on your behalf by using our Data Subject Request Form, or by calling us toll-free at 888-577-7688 ext. 2.

8. Nevada Residents.

If you are a Nevada resident, under Nevada law, you may request that we refrain from sale of your Personal Information to an entity, for the entity to further sell the information to additional organizations or persons. We do not sell your Personal Information pursuant to Nevada law. If you have a question, concern, or request with respect to your Personal Information under Nevada law, please contact us at [email protected] for more information or to exercise your rights. We will reply to any request within sixty (60) days of receipt. We may extend this request for not more than thirty (30) days if we determine the extension is reasonably necessary, and in which case we will notify you of our intent to invoke the extension.

9. California Residents.

A. Shine the Light. As provided under California Civil Code Section 1798.83, also known as the “Shine The Light” law, we provide our California customers with whom we have an established business relationship the ability to “opt out” of having their Personal Information shared with affiliated and non-affiliated third parties for their direct marketing purposes. You may opt-out of having your Personal Information shared with affiliated and non-affiliated third parties for their direct marketing purposes in by contacting Sprouts at [email protected].

B. California Sensitive Information Disclosure. Note that we do not use sensitive information collected from you for any purposes that are not identified within the California Consumer Privacy Act Section 1798.121. We do not “sell” or “share” sensitive Personal Information for purposes of cross-context behavioral advertising.

C. Notice of Financial Incentive. We offer programs that provide certain perks, such as rewards, promotions, and exclusive offers (the “Rewards Programs”). When you sign up for a Reward Program, we will ask you to provide your name, email address, postal/zip code, and your telephone number. Because our Rewards Program involves the collection of Personal Information, it might be interpreted as a “financial incentive” program under California law. We do not assign a monetary value to the information we collect. Based on our reasonable estimate, the value of your Personal Information to us is related to the value of the free or discounted products or services that you obtain when you redeem points. This value is based on the expense related to offering those free or discounted products or services. You may withdraw from participating in the Rewards Program at any time by contacting us at the address described in the program terms and conditions. 10. Sprouts Rewards and Your Personal Information.

As mentioned in the California Residents section, we offer Rewards Programs that provide you with certain perks. When you sign up for Sprouts Rewards, we will ask you to provide your name, email address, postal/zip code, and your telephone number.

Note that if you submit a valid deletion request as described under Your Privacy Choices, we will not be able to continue your full participation in the Rewards Program. This is because our Rewards Program members’ Personal Information is required in order to identify such members and administer the Rewards Program’s benefits.

Some of the products that we sell could be considered as allowing someone to make an inference about your health status. We do not maintain and otherwise delete these inferences within 24 hours of the purchase and will not provide you with personalized benefits through the Rewards Program as a result of these inferences.

11. Changes to Our Privacy Policy.

If we decide to change our Privacy Policy in whole or in part, we will inform you by posting a notice on our Site, as applicable. Those changes will go into effect on the effective date posted in the notice and at the end of the revised Privacy Policy. The Privacy Policy that was in effect at the time you submitted Personal Information to us will apply.
